These terms outline the agreement between you and Meg Russell Photography when you purchase prints or use this website. I've tried to make this as straightforward as possible while still covering the important legal stuff.

1. Agreement to Terms

By accessing or using scrunchymom.com (the "Website"), placing an order, or purchasing any products, you agree to be bound by these Terms and Conditions ("Terms"). If you don't agree with any part of these Terms, please don't use the Website or purchase products.

These Terms apply to all visitors, users, and customers of Scrunchy Mom.

Meg Russell Photography is a fine art photography business operated by Meg Stone, an S Corporation registered in California. All references to "I," "me," "my," or "Meg Stone" refer to this business and its owner.

• Promotional prices and discounts are valid only for the specified time period

• Pricing errors: If a product is listed at an incorrect price due to an error, I reserve the right to cancel the order and notify you

Availability

All products are subject to availability. While I strive to keep accurate inventory, occasionally a product may be out of stock. If this happens, I'll notify you promptly and offer a refund or suggest an alternative.

5. Orders and Payment

Order Acceptance

When you place an order, you're making an offer to purchase. I reserve the right to accept or decline any order for any reason, including but not limited to:

• Product availability

• Errors in product or pricing information

• Suspected fraudulent activity

• Issues with payment authorization

Your order is considered accepted when you receive an order confirmation email from me. This email constitutes acceptance of your offer and creates a binding contract.

Payment

Payment is processed securely through Squarespace and Stripe. By providing payment information, you represent that:

• You're authorized to use the payment method

• All information you provide is accurate and complete

• You'll pay all charges incurred

Payment is due in full at the time of purchase. I accept major credit cards and other payment methods as available through Squarespace.

Payment Plans

If you use a payment plan service (such as Shop Pay installments), you're entering into a separate agreement with that service provider. I'm not responsible for their terms, fees, or collection practices.

Sales Tax

Sales tax will be charged where required by law. The amount will be calculated and displayed at checkout based on your shipping address.

6. Shipping and Delivery

Shipping Times

• Most orders ship within 3-5 business days of order confirmation

• Transit times vary based on your location and selected shipping method

• Delays may occur during holidays or peak seasons

Shipping Address

You're responsible for providing an accurate shipping address. I'm not responsible for orders shipped to incorrect addresses provided by you. If a package is returned due to an incorrect or incomplete address, you may be responsible for additional shipping charges to resend.

Risk of Loss

Once a package is picked up by the shipping carrier, risk of loss transfers to you. However, if your order arrives damaged, please contact me immediately and I'll work with you to resolve the issue.

Delivery Issues

If you don't receive your order within the expected timeframe, please contact me at hello@scrunchymom.com and I'll help track down your package.

7. Returns and Refunds

Return Window

You may return prints within 14 days of delivery for a full refund, provided they're in original condition.

Non-Returnable Items

The following cannot be returned:

• Custom or personalized prints (if offered in the future)

• Prints that have been framed or altered

• Digital products or downloads (if offered)

Refund Process

Once I receive and inspect your return, I'll process your refund within 5-7 business days. Refunds are issued to the original payment method. Please allow additional time for your bank or credit card company to process the refund.

Damaged or Defective Items

If your print arrives damaged or has a manufacturing defect, please contact me within 48 hours of delivery with photos. I'll send a replacement at no additional cost.

8. Intellectual Property Rights

Copyright Ownership

All images, photographs, designs, text, graphics, and other content on this Website are the exclusive property of Scrunchy Mom and are protected by US and international copyright laws.

When you purchase a print, you're purchasing a physical copy of the artwork for personal display only. You do NOT acquire any rights to:

• Reproduce or copy the image

• Distribute or sell copies

• Create derivative works

• Use the image for commercial purposes

• Display the image publicly online without permission

Permitted Uses

You may:

• Display your purchased print in your home or private space

• Share photos of the print in your space on social media for personal, non-commercial purposes (with credit to @scrunchymom appreciated)

Watermarks and Signatures

You may not remove, alter, or obscure any watermarks, signatures, or copyright notices from purchased prints or digital images.

Website Content

All Website content, including the design, layout, text, and graphics, is protected by copyright. You may not copy, reproduce, or use any content without my written permission.

9. Licensing for Commercial Use

If you're interested in using my images for commercial purposes (such as in your business, publications, or products), you must obtain a separate commercial license. Please contact me at hello@scrunchymom.com to discuss licensing options.

Unauthorized commercial use of my images may result in legal action and liability for damages.

10. Disclaimers and Limitation of Liability

This Website and all products are provided on an "as is" and "as available" basis. I make no warranties, express or implied, regarding:

Limitation of Liability

These minor variations are normal and do not constitute grounds for return unless the variation is significant.

11. Indemnification

You agree to indemnify and hold harmless Scrunchy Mom, its owner, and any affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
